Back to Brand Protection

What is Counterfeit?

  • Counterfeit – Unauthorised reproduction of a trade mark or brand
  • Over Production – Original high quality product, produced beyond the scope of the commercial agreement
  • Look-alike – Copy the look and feel of a product, but do not reproduce the brand.
  • Grey Market – Original Products sold beyond the scope of the commercial agreement.

Hazards of Counterfeit

  • Licensed goods are extremely attractive to counterfeiters!
    • Enforcement officers and consumers do not know whether a product is officially licensed or not.
    • Multiple brands can be applied to the same product line
    • Very high return, low enforcement priority, low penalty
  • Counterfeiters make more money than you!
    • No development costs, no marketing, no taxes, no royalties
  • Counterfeit damages valuable brand equity
  • Reduces sales for legitimate licensees
  • Impacts on royalty revenues
  • There are potentially hazardous goods for sale with your brand on them.
